Welcome to Diyo Art (“we,” “us,” or “our”). By accessing or using diyoart.com (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
You must be at least 18 years old to use the Service. By creating an account, you confirm that you meet this requirement.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@diyoart.com if you suspect unauthorized access.
Diyo Art provides an AI-powered ketubah design tool. You can browse designs, customize text and layout, and purchase a high-resolution digital download of your ketubah. Design creation and customization are free; fees apply only when you purchase a final product.
Ketubah artwork is generated using artificial intelligence based on your selected theme and style preferences. Because AI generation is inherently variable, we cannot guarantee that generated designs will exactly match your expectations. You have the opportunity to review your design before purchasing.
Your Content: You retain ownership of the personal information and text you provide (names, dates, custom text). Upon purchasing a design, you receive a personal-use license to the generated ketubah artwork for display, printing, and personal enjoyment.
Our Content: The Diyo Art website, software, brand elements, and underlying AI models remain our intellectual property. You may not reproduce, distribute, or create derivative works from our platform or its components.
Restrictions: Purchased ketubot are licensed for personal use only. You may not resell, sublicense, or commercially distribute the generated artwork.
All prices are listed in USD or CAD and include applicable fees. Payments are processed securely by Stripe. We accept credit/debit cards, Apple Pay, and Google Pay. You agree to pay all charges associated with your order at the prices in effect when you place it.
Digital ketubah files are delivered as high-resolution images suitable for professional printing. Once a digital download has been delivered, it is non-refundable, as the product is fully delivered at the time of download. If there is a defect or issue with your file, contact us and we will work to resolve it.
You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to our systems; interfere with or disrupt the Service; submit content that is offensive, fraudulent, or infringes on others’ rights; scrape, harvest, or collect data from the Service; overload or attempt to overwhelm our infrastructure; or use automated means to access the Service without our permission.
The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated designs will meet specific expectations. Color accuracy may vary between screens and printed output.
To the fullest extent permitted by law, Diyo Art shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
You may delete your account at any time from your account settings. We reserve the right to suspend or terminate any account at our discretion, including for violations of these terms or any activity we reasonably believe is harmful to the Service or other users. Upon termination, your designs and personal data will be deleted in accordance with our Privacy Policy.
You agree to indemnify and hold harmless Diyo Art, its owners, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or any content you submit through the Service.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised terms. We will update the date at the top of this page when changes are made.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, either party may pursue resolution in the courts of the Province of Ontario, Canada, and you consent to the exclusive jurisdiction of those courts.
We are not liable for any delay or failure to perform our obligations when caused by circumstances beyond our reasonable control, such as natural disasters, service outages from our infrastructure providers, government actions, or other events of that nature.
